1. Agreement

These Terms are an agreement between you and Zargham Labs LLC, 1001 S Main St, STE 600, Kalispell, MT 59901, USA ("we", "us"), covering the Dawakara app and dawakara.com (together, the "Service"). By using the Service you accept these Terms. If you don't agree, please don't use it.

2. What Dawakara is, and isn't

Dawakara is a tool for recording your medicines and receiving reminders based on the information you enter. It is not a medical device and does not provide medical advice, diagnosis or treatment. It doesn't check doses, interactions or suitability. Always follow the instructions of your doctor, pharmacist or other qualified health professional. See our Medical Disclaimer. Do not use Dawakara for emergencies.

3. Reminders can fail

Reminders depend on your device, its operating system, battery and power-saving settings, notification and alarm permissions, Do Not Disturb, the volume, and whether the device is on and working. We work hard to make reminders reliable and provide setup guides, but we can't guarantee that every reminder will be delivered or delivered on time. You remain responsible for taking your medicines correctly. For medicines where a missed or late dose could cause serious harm, use additional reminders and talk to your health professional.

4. Eligibility

You must be at least 13 years old (16 in the EU/UK), or have a parent or guardian's permission. If you manage information about another person, such as a parent or child, you confirm you have their permission or the legal authority to do so.

5. Your information

Information you enter belongs to you. Our Privacy Policy explains how we handle it. You're responsible for keeping your device, app lock and backup passphrase safe. We can't recover end-to-end encrypted data or backup files if you lose your passphrase or recovery phrase.

6. Dawakara Family (optional subscription)

Some features need a paid subscription. Payments are handled by the app store you downloaded Dawakara from, under its terms.
Subscriptions renew automatically until cancelled. You can manage or cancel your subscription in your app store account settings.
Refunds are handled under the app store's refund policies and any rights you have under local law.
Cancelling a subscription does not delete your data; see Delete your data. Deleting the App does not cancel a subscription.
We will give notice in the App before making material changes to subscription features.
Core features (reminders, dose log, refill alerts, reports and up to two profiles on one device) don't require a subscription.

7. Family groups

The person who creates a family group can invite others and remove members. Members can see the shared schedules, dose logs and alerts for profiles shared with the group. Only invite people you trust. Anyone can leave a group at any time.

8. Acceptable use

Don't misuse the Service. For example, don't try to access other people's data, disrupt or overload our servers, reverse-engineer the encryption to attack other users, or use the Service in violation of law.

9. Our intellectual property

The App, Site, name, logo and content belong to Zargham Labs LLC or its licensors. We grant you a personal, non-transferable, revocable licence to use the App for its intended purpose.

10. Changes and availability

We may update the Service and these Terms. If changes are material, we'll notify you in the App or on the Site before they take effect. We may suspend the Family service for maintenance or security. Features on your device keep working offline.

11. Disclaimers

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and uninterrupted operation or operation without errors.

12. Limitation of liability

To the extent the law allows, Zargham Labs LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for harm arising from missed, late or incorrect reminders or from information you entered. Our total liability for any claim related to the Service is limited to the greater of the amount you paid for the Service in the 12 months before the claim or USD 50. Nothing in these Terms limits liability that can't be limited by law, including your statutory rights as a consumer in your country.

13. Governing law

These Terms are governed by the laws of the State of Montana, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Flathead County, Montana, unless the law of your country gives you the right to bring a claim in your local courts.

14. Termination

You can stop using the Service at any time. We may suspend or end access to Family features if you seriously breach these Terms. Sections 2, 3, 5, 11, 12 and 13 survive.
